These Terms of Use ("Terms") govern your access to and use of varsitydraft.com, the The Sports Parent Brief newsletter, and related services (the "Services"), provided by Varsity Draft ("we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

We reserve all rights not expressly granted. You may share links to our guides and articles with appropriate attribution, but you acquire no ownership or license beyond the limited rights stated here.

No professional advice

The Services provide guides, commentary, and general information about youth sports. They are not medical, legal, financial, or professional coaching advice, and you should not rely on them as such. For decisions about your child's health, safety, or eligibility, consult qualified professionals. You are solely responsible for decisions you make based on the Services.

The Services may reference or link to third-party websites, products, camps, tournaments, and services. We do not control and are not responsible for third-party materials, and a link does not imply endorsement. Your dealings with third parties — including equipment purchases, camp registrations, or recruiting services — are solely between you and them.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VARSITY DRAFT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).

Indemnification

You agree to indemnify, defend, and hold harmless Varsity Draft and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services or your violation of these Terms.

Changes and termination

We may modify, suspend, or discontinue the Services, or update these Terms, at any time. Changes to the Terms are effective when posted, and your continued use constitutes acceptance. We may suspend or terminate your access at our discretion, including for any violation of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively by binding individual arbitration, and you and Varsity Draft waive any right to a jury trial or to participate in a class or representative action, to the fullest extent permitted by law. If any provision is found unenforceable, the remaining provisions remain in effect.
